4. Teilnahmeberechtigung

4.1 Teilnahmeberechtigt sind alle natürlichen Personen über 18 Jahren mit Wohnanschrift in Deutschland.
4.2.Die Teilnahme über einen Gewinnspiel-Teilnahmeservice sowie mittels softwaregestützter oder sonstiger automatischer Registrierung ist nicht zulässig; teilnehmen darf nur, wer sich persönlich registriert.
4.3 Die Teilnahmeberechtigung setzt weiter voraus, dass der/die Teilnehmer/in sich unter zutreffender Angabe seiner/ihrer  dort abgefragten persönlichen Daten registriert und der Geltung dieser Teilnahmebedingungen zustimmt.
4.4 Ausgeschlossen von der Teilnahme sind die Mitarbeiter der Georg Plange ZN der PMG Premium Mühlen Gruppe GmbH & Co. KG und deren Familien- oder Haushaltsangehörige sowie beteiligte Dienstleister.


5. Gewinnspiel

5.1 An dem Gewinnspiel nehmen alle Personen teil, die im Gewinnspielzeitraum folgende Bedingungen erfüllen:
1. auf https://www.ichliebebacken.de als User registriert sind
2. im Aktionszeitraum mindestens ein Rezept für einen Geburtstagskuchen oder eine Geburtstagstorte in die Rezeptebox auf https://www.ichliebebacken.de einstellen.

5.2 Die Benachrichtigung der Gewinner erfolgt über die Facebook-Seite Ich liebe Backen am 28. Juli 2018.

5.3 Gewinn:

Der Gewinner oder die Gewinnerin erhält ein Set aus dem Sortiment von unserem Aktionspartner https://www.backfeiuer.de, bestehend aus:

5.4 Eine Barauszahlung des Gewinns ist ebenso ausgeschlossen wie eine Aufrechnung gegen eine bestehende Forderung von Plange.

5.5 Die Gewinne werden nach Gewinnspielschluss innerhalb von 3 Tagen per DHL versandt.

5.6 Der Rechtsweg ist ausgeschlossen.

7. Prüfung der übermittelten Inhalte, Löschung, Pflichten des Teilnehmers
Mit Versand des ausgefüllten Registrierungs-Formulars über dem Button „Neues Benutzerkonto erstellen“ oder bei bereits bestehendem Benutzerkonto über in dem Bereich „neues Rezept anlegen“ und dem Button „Speichern“ versichern Sie, dass die Teilnahmevoraussetzungen gemäß Ziffer 4.1 bis 4.4 hinsichtlich Teilnahme erfüllt sind.

8. Disqualifikation von Teilnehmern

Plange ist berechtigt, einen Teilnehmer von der Teilnahme auszuschließen, wenn der begründete Verdacht besteht, dass dieser Teilnehmer vorsätzlich gegen diese Teilnahmebedingungen zu verstoßen, das Gewinnspiel bzw. den Teilnahmevorgang zu manipulieren oder in sonstiger unlauterer Weise zu beeinflussen versucht.

9. Vorzeitige Beendigung des Gewinnspiels

9.1 Plange behält sich vor, dieses Gewinnspiel ganz oder in Teilen jederzeit vorzeitig zu beenden. Die Beendigung wird in diesem Fall auf der Aktions-Website bekannt gegeben.
9.2. Sollte sich herausstellen, dass dieses Gewinnspiel ganz oder in Teilen gegen geltendes Recht oder gegen gerichtliche oder behördliche Auflagen verstößt, ist Plange berechtigt, das Gewinnspiel und die Ermittlung der Gewinner im erforderlichen Umfang ohne Einhaltung von Fristen jederzeit anzupassen oder einzustellen. Die registrierten Teilnehmer/innen werden hierüber durch einen Hinweis auf der Aktions-Website unverzüglich informiert. Den Teilnehmenden stehen keine Ansprüche gegen Plange wegen dieser vorzeitigen Anpassung oder Beendigung zu.

10. Haftungsbeschränkung

Die Ansprüche der Teilnehmer/innen auf Schadenersatz oder Ersatzaufwendungen richten sich nach den folgenden Regelungen:
(1) Für Schäden aus der Verletzung des Lebens, des Körpers oder der Gesundheit, die auf einer fahrlässigen Pflichtverletzung oder einer vorsätzlichen oder fahrlässigen Pflichtverletzung eines gesetzlichen Vertreters oder Erfüllungsgehilfen beruhen, haftet Plange unbeschränkt.
(2) Im Übrigen haftet Plange nur,
- bei der Verletzung wesentlicher Vertragspflichten für Vorsatz und jeder Fahrlässigkeit. Wesentliche Vertragspflichten sind Pflichten, deren Erfüllung die ordnungsgemäße Durchführung des Vertrages überhaupt erst ermöglicht und auf deren Einhaltung der Teilnehmer/die Teilnehmerin regelmäßig vertrauen darf. Der Höhe nach ist die Haftung auf den typisch vorhersehbaren Schaden begrenzt. Die Haftung für Folge- und Vermögensschäden (z. B. entgangener Gewinn) ist bei fahrlässiger Verletzung ausgeschlossen.
- bei der Verletzung sonstiger Vertragspflichten nur für durch Vorsatz oder grobe Fahrlässigkeit verursachte Sach- und Vermögensschäden. Der Höhe nach ist die Haftung bei fahrlässigem Handeln begrenzt auf den typisch vorhersehbaren Schaden. Die Haftung für Folge- und Vermögensschäden (z. 12. Schlussbestimmungen

12.2 Plange behält sich vor, diese Teilnahmebedingungen jederzeit mit Wirkung für die Zukunft zu ändern oder zu ergänzen. Die Änderung oder Ergänzung wird auf der Aktions-Website bekannt gemacht, und die registrierten Teilnehmer werden hierüber zusätzlich per E-Mail informiert.
Die Zustimmung des Teilnehmers/der Teilnehmerin gilt als erteilt, wenn er/sie nicht innerhalb von zwei Wochen nach Zugang der Information in Textform widerspricht.
Widerspricht ein Teilnehmer/eine Teilnehmerin der Änderung oder Ergänzung der Teilnahmebedingungen, kann Plange das durch die Teilnahmebedingungen geregelte Rechtsverhältnis mit diesem Teilnehmer fristlos kündigen.
12.3 Es gilt ausschließlich das Recht der Bundesrepublik Deutschland.
